Creating and monitoring a Minimum Advertised Pricing Policy allows a manufacturer to maintain its brand integrity and online distribution. The manufacturer should immediately let all of its retailers know the policy was implemented and make sure to let violators know they’ve been identified. Adhering to the MAPP is a way for all retailers to feel confident that the manufacturer has their back, and allows them to maintain healthy margins while continuing to sell high-quality, innovative products.

Is MAP an illegal price-fixing scheme?

It tells them the lowest price at which they may “advertise” the product. This was clearly recognized in the Leegin Creative Leather Products, Inc. v. PSKS, Inc., 551 U.S. 877 (2007) case, wherein the Supreme Court overruled a century-old precedent and held that minimum resale price maintenance (RPM) is not technically illegal under Section 1 of the Sherman Act and should instead be subject to the antitrust rule of reason (which requires a case-by-case analysis).

Manufacturers have also adopted many different types of online merchant policies to help them maintain the integrity of their brands. These policies include, but are not limited to: MAP (Minimum Advertised Pricing), Intellectual Property Use, Authorized Reseller and more. But no matter what your policy is, there’s no point in having one if you don’t monitor, identify and enforce.
